Arizona DUI Laws – 1st Offense
First offense (BAC .08%-.149%) results in a 90 day driver’s license suspension and carries fines of approximately $1,800 plus jail costs if applicable. Jail term is from 10-180 days, although compliance with treatment orders and evaluation can reduce this to 1 day. A substance abuse program may be required by the court and probation for up to five years is possible depending upon the circumstances of the DUI arrest. The court may also order attendance at one or more MADD (Mothers Against Drunk Driving) Victim Impact Panels. After 30 days a restricted work/school license may be applied for. An ignition interlock device must be installed in the convicted drivers vehicle for 1 year. For an Extreme DUI (BAC .15%-.199%) jail term is increased to 30-180 days, which may be reduced to 10 through compliance with evaluation and treatment orders. Fines increase to approximately $3,000 plus jail costs. For a Super Extreme DUI (BAC .20% or greater) jail term increases to 45-180 days with no chance to reduce the 45 consecutive day minimum. Fines increase to approximately $3,250 plus jail costs. An ignition interlock device will be required for 18 months. If you refuse BAC testing driver’s license revocation period will be increased to one year.
Arizona DUI Laws – 2nd Offense
Second offense within 7 years (BAC .08%-.149%) results in a 1 year driver’s license suspension and carries fines of approximately $3,500 plus jail costs if applicable. Jail term is 90-180 days, although compliance with treatment orders and evaluation can reduce this to 30 days. A minimum 30 days of community service will be imposed. A substance abuse program may be required by the court and probation for up to five years is possible depending upon the circumstances of the DUI arrest. The court may also order attendance at one or more MADD (Mothers Against Drunk Driving) Victim Impact Panels. An ignition interlock device must be installed in the convicted drivers vehicle for 1 year. For an Extreme DUI (BAC .15%-.199%) jail term is increased to 120-180 days, which may be reduced to 60 through compliance with evaluation and treatment orders. Fines increase to approximately $3,750 plus jail costs. For a Super Extreme DUI (BAC .20% or greater) jail term increases to a mandatory 180 days with no chance to reduce. 90 days must be served consecutively. Fines increase to approximately $4,000 plus jail costs. An ignition interlock device will be required for 2 years. If you refuse BAC testing driver’s license revocation period will be increased to 2 years.
Arizona DUI Laws – 3rd Offense
Third offense within 7 years, or being convicted of DUI while having a suspended/revoked license, is considered a Class 4 Felony Aggravated DUI and results in up to $150,000 in fines and 4 months minimum in prison with up to five years probation. Vehicle confiscation is also a possibility. The same penalties will be imposed for a Class 6 Felony Aggravated DUI which occurs when the person arrested for DUI has one or more passengers under the age of 15.
