Iowa DUI Laws – 1st Offense
First offense results in a driver’s license suspension for 180 days, fines from $625-$1,250, and a jail term from 48 hours to 1 year. Court may order substance abuse evaluation and treatment as well as community service. If BAC test was refused, license suspension is increased to 1 year. Restricted license may be available immediately if BAC was below .10%, or with an Ignition Interlock device if BAC was .11%-.15%. For BAC above .15%, restricted license available after 30 days.
Iowa DUI Laws – 2nd Offense
Second offense results in a driver’s license suspension of 2 years, fines from $1,875-$6,250, and a jail term from 7 days to 2 years. Court may order substance abuse evaluation and treatment as well as community service. If BAC test was refused, license suspension is increased to 1 year. Restricted license may be available after 90 days for a deferred judgement or after 1 year with an Ignition Interlock device.
Iowa DUI Laws – 3rd Offense
Third and future offense is considered a Class D felony and results in a driver’s license suspension of 6 years, fines from $3,125-$9,375, and a jail term from 30 days to 5 years. Court may order substance abuse evaluation and treatment as well as community service and car impoundment.

Anyone driving a vehicle in Iowa has given implied consent to submit to a BAC test.
Iowa DUI Laws – “Per se” BAC Level
The per se BAC level in Iowa is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.
Iowa DUI Laws – “Zero Tolerance” BAC Level
The zero tolerance BAC level in Iowa is .o2%. Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.
