Louisiana DUI Laws – 1st Offense
First offense results in a driver’s license suspension for 90 days, fines of $1,000, and a jail term of up to 6 months. Court may order substance abuse evaluation and treatment as well as community service. If BAC test was refused, license suspension is increased to 180 days.
Louisiana DUI Laws – 2nd Offense
Second offense results in a driver’s license suspension for 1 year, fines of $1,000, and a jail term from 48 hours (mandatory) to 6 months. If BAC test was refused for a second time, license suspension is increased to 545 days.
Louisiana DUI Laws – 3rd Offense
Third offense is considered a felony and results in a driver’s license suspension for 2 years, fines of $2,000, and a jail term from 45 days (mandatory) to 5 years. A 6 week inpatient substance abuse program will be ordered, as well as 30 days community service.
Louisiana DUI Laws – 4th Offense
Fourth offense is considered a felony and results in a driver’s license suspension for 2 years, fines of $5,000, and a jail term from 75 days (mandatory) to 30 years. A 6 week inpatient substance abuse program will be ordered, as well as 40 days community service. Vehicle may be impounded and/or sold.

Anyone driving a vehicle in Louisiana has given implied consent to submit to a BAC test.

The per se BAC level in Louisiana is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.
Louisiana DUI Laws – “Zero Tolerance” BAC Level
The zero tolerance BAC level in Louisiana is .o2%. Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.
