Maine DUI Laws – 1st Offense

First offense results in a driver’s license suspension for 90 days, fines of $500, and a jail term of 30 days.  Upon reinstatement of license, a conditional period will be required for 1 year in which a driver found to have any alcohol in his/her blood can have their license revoked for one year without a hearing.  If there is another DUI conviction the conditional period will be increased to 10 years.

Maine DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension for 3 years, fines of $1000 minimum, and a jail term of 6 months.  License suspension may be reduced to 9 months with installation of Ignition Interlock device.

Maine DUI Laws – 3rd Offense

Third offense results in a driver’s license suspension for 6 years, fines of $1000 minimum, and a jail term of 9 months and 1 day.  License suspension may be reduced to 3 years with installation of Ignition Interlock device.

Maine DUI Laws – 4th Offense

Fourth offense results in a driver’s license suspension for 6 years, fines of $1000 minimum, and a jail term of 2 years.  Ignition Interlock device is required after 6 year suspension is served.

The per se BAC level in Maine is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

Maine DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in Maine is .o0%.  Anyone under the age of 21 driving with a BAC of .00% or greater can be charged with DUI.

Maine enforces enhanced penalties is consent for BAC test is refused which results in increased penalties.
