First offense for DWI (BAC .07%-.079%) results in a driver’s license suspension for 6 months minimum, fines up to $500 ($1,000 with minor in vehicle), and a jail term of up to 2 months (6 months with minor in vehicle). First refusal of a BAC test may result in a 120 day license suspension.
Maryland DUI Laws – 2nd Offense
Second offense for DUI (BAC .08% or greater) results in a driver’s license suspension for 1 year, fines up to $2,000 (3,000 with minor in vehicle), and a jail term of up to 2 years (3 years with minor in vehicle). An Ignition Interlock device may be available after 45 days of suspension. Second offense for DWI (BAC .07%-.079%) results in a driver’s license suspension for 1 year, fines up to $500 ($2,000 with minor in vehicle), and a jail term of up to 1 year. Second refusal of a BAC test carries a mandatory 1 year license suspension.
Maryland DUI Laws – 3rd Offense
Third and future offenses for DUI or DWI results in a driver’s license suspension for 18 months minimum, fines up to $3,000 (4,000 with minor in vehicle), and a jail term of up to 3 years (4 years with minor in vehicle).
