Michigan DUI Laws – 1st Offense

First offense results in a driver’s license suspension for up to 6 months (restricted license available after 30 days), fines from $100 to $500, and a jail term of up to 93 days.  6 points will be added to your license.  The court may also require up to 360 hours community service, an Ignition Interlock device, and vehicle immobilization.

Michigan DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension for a minimum 1 year, fines from $200 to $1,000 plus a $1,000 driver responsibility fee, and a jail term from 5 days to 1 year.  6 points will be added to your license, and the license plates will be confiscated.  The court may also require from 20-90 days community service, an Ignition Interlock device, and vehicle immobilization from 90-180 days.

Michigan DUI Laws – 3rd Offense

Third and future offense is considered a felony and results in a driver’s license suspension for a minimum 1 year, fines from $200 to $1,000 plus a $1,000 driver responsibility fee, and a jail term from 1 to 5 years.  6 points will be added to your license, and the license plates will be confiscated.  The court may also require from 60-180 days community service, an Ignition Interlock device, and vehicle immobilization from 90-180 days.


Michigan DUI Laws – Implied Consent Laws

Anyone driving a vehicle in Michigan has given implied consent to submit to a BAC test.

 

Michigan DUI Laws – “Per se” BAC Level

The per se BAC level in Michigan is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

Michigan DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in Michigan is .02%.  Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.

 

Michigan DUI Laws – “Enhanced Penalty” BAC Level

Michigan does not enforce Enhanced Penalties.
