Missouri DUI Laws – 1st Offense
First offense results in a full driver’s license suspension for 30 days plus 60 days restricted and a $45 reinstatement fee, fines up to $500, and a jail term of up to 6 months. Court may order Ignition Interlock device. Proof of insurance is required.

Second offense results in a full driver’s license suspension for 1 year (5 years if within 5 years of first offense) plus $45 reinstatement fee, fines up to $1,000, and a jail term of up to 1 year. Court may order Ignition Interlock device after 1 of year suspension is fulfilled. Proof of insurance is required.

Third offense results in a full driver’s license suspension for 10 years plus $45 reinstatement fee, fines up to $5,000, and a jail term of up to 4 years. Court will order Ignition Interlock device after suspension is fulfilled. Proof of insurance is required.

Anyone driving a vehicle in Missouri has given implied consent to submit to a BAC test. Refusal results in a mandatory 1 year license suspension plus 2 points and is considered a class A misdemeanor.

The per se BAC level in Missouri is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.
Missouri DUI Laws – “Zero Tolerance” BAC Level
The zero tolerance BAC level in Missouri is .o2%. Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.
Missouri DUI Laws – “Enhanced Penalty” BAC Level
There are enhanced penalties in Missouri for driving with a BAC of .15% or over. License suspension time for first offense is increased to 90 days plus 275 days restricted. Also increases the charge from a class B misdemeanor to a class A misdemeanor.
