New Jersey DUI Laws – 1st Offense

First offense results in a driver’s license suspension for 3 months (7 months to 1 year with BAL .10% or greater),  fines from $250-$400 (or $300-$500 with BAL over .10% ),  jail term of up to 30 days, DWI fees of $525 minimum, an auto insurance surcharge of $1,000 for 3 years, 2 day attendance in a 6 hour Intoxicated Driver Resource Center,  and the court may order an Ignition Interlock device.

New Jersey DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension for 2 years,  fines from $500-$1,000,  jail term of up to 90 days, DWI fees of $525 minimum, an auto insurance surcharge of $1,000 for 3 years, 30 days community service,  and the court may order an Ignition Interlock device.

New Jersey DUI Laws – 3rd Offense

Third offense results in a driver’s license suspension for 10 years,  fine of $1,000,  jail term of up to 180 days, DWI fees of $525 minimum, an auto insurance surcharge of $1,500 for 3 years,  and the court may order an Ignition Interlock device.

New Jersey DUI Laws – Implied Consent Laws

Anyone driving a vehicle in New Jersey has given implied consent to submit to a BAC test.  First refusal of BAC test results in a 7 month to 1 year suspension and an Ignition Interlock device for 6 months to 1 year.  Second refusal results in up to 2 years suspension plus Ignition Interlock device for 3 years.  Third refusal results in a 10 year license suspension.

 

New Jersey DUI Laws – “Per se” BAC Level

The per se BAC level in New Jersey is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

New Jersey DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in New Jersey is .o1%.  Anyone under the age of 21 driving with a BAC of .01% or greater can be charged with DUI.

 

New Jersey DUI Laws – “Enhanced Penalty” BAC Level

There are enhanced penalties in New Jersey at a BAC of .10% or greater that increase fines and license suspension time.  There are also enhanced penalties for dui in a school zone.
