Oregon DUI Laws – 1st Offense
First offense results in a driver’s license suspension for 1 year, fines of $1,000 minimum ($2,000 minimum with a BAC .15% or greater, up to $10,000 with a passenger under 18 that was 3 years younger than driver), and jail term from 48 hours to 1 year (or 80 hours community service). DUI fees of $300 minimum as well as an Ignition Interlock device for 1 year will be ordered by the court, as well as a drug/alcohol treatment program. Participation in a Victim Impact Panel program is also required.
Oregon DUI Laws – 2nd Offense
Second offense results in a driver’s license suspension for 3 years if within five years of previous, fines of $1,500 minimum ($2,000 minimum with a BAC .15% or greater, up to $10,000 with a passenger under 18 that was 3 years younger than driver), and jail term of up to 1 year. DUI fees of $300 minimum as well as an Ignition Interlock device for 2 years will be ordered by the court, as well as a drug/alcohol treatment program. Participation in a Victim Impact Panel program is also required.

Third offense is considered a Class C Felony (if other offenses within 10 years) and results in a permanent driver’s license suspension, fines of $2,000 minimum ( up to $10,000 with a passenger under 18 that was 3 years younger than driver), and jail term of up to 5 years. DUI fees of $300 minimum as well as an Ignition Interlock device for 3 years will be ordered by the court, as well as a drug/alcohol treatment program. Participation in a Victim Impact Panel program is also required.

Anyone driving a vehicle in Oregon has given implied consent to submit to a BAC test. First refusal results in an automatic 1 year license suspension. Second refusal within 5 years of any alcohol-related violation results in a 3 year suspension.
