Rhode Island DUI Laws – 1st Offense

First offense results in a jail term up to 1 year and/or community service for 10 to 60 hours, a $500 Highway assessment fee, and a Driving While Intoxicated class.  For a BAC .08%-.10%, fines of $100-$300 and a license suspension from 30 to 180 days will be imposed.  For a BAC .11%-.15%, fines of $100-$400 and a license suspension from 3 months to 12 months will be imposed.  For a BAC greater than .15%, fine of $500 and a license suspension from 3 to 18 months.

Rhode Island DUI Laws – 2nd Offense

Second offense results in a jail term up to 1 year, a $500 Highway assessment fee, and a Driving While Intoxicated class.  For a BAC .08%-.15%, fines of $400 and a license suspension for up to 2 years will be imposed.  For a BAC greater than .15%, fine of $1,000 and a license suspension for 2 years.  An Ignition Interlock device may be required, as well as a drug/alcohol treatment program.

Rhode Island DUI Laws – 3rd Offense

Third offense is considered a felony and results in a $500 Highway assessment fee, and a Driving While Intoxicated class.  For a BAC .08%-.15%, fines of $400 and a license suspension for 2 to 3 years will be imposed as well as a jail term of 1 to 3 years.  For a BAC greater than .15%, fine of $1,000-$5000, a license suspension for 3 years, as well as 3-5 years jail time, plus vehicle may be seized and sold by the state.   An Ignition Interlock device may be required, as well as a drug/alcohol treatment program.

Rhode Island DUI Laws – Implied Consent Laws

Anyone driving a vehicle in Rhode Island has given implied consent to submit to a BAC test.  First refusal results in an automatic 6 month license suspension.  Second refusal results in a 1 year suspension.

 

Ohio DUI Laws – “Per se” BAC Level

The per se BAC level in Rhode Island is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

Rhode Island DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in Rhode Island is .o2%.  Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.

 

Rhode Island DUI Laws – “Enhanced Penalty” BAC Level

There are enhanced penalties in Rhode Island that increase fines and jail time.  DUI resulting in death merits a 5 to 15 year jail sentence, fines from $5,000 to $10,000, and a revoked license for 5 years.
