Texas DUI Laws – 1st Offense

First offense results in a driver’s license suspension from 90-365 days, fines up to $2,000 (up to $10,000 with child under 15 in vehicle),  and jail term from 72 hours to 180 days (180 days to 2 years with child under 15 in vehicle).  A DWI surcharge of $1,000 ($2,000 for BAC .16 or greater) will be applied for 3 years.

Texas DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension from 180 days to 2 years, fines up to $4,000 (up to $10,000 with child under 15 in vehicle),  and jail term from 30 days to 1 year (180 days to 2 years with child under 15 in vehicle).  A DWI surcharge of $1,500 ($2,000 for BAC .16 or greater) will be applied for 3 years.  An Ignition Interlock device will be ordered by the court.

Texas DUI Laws – 3rd Offense

Third offense results in a driver’s license suspension from 180 days to 2 years, fines up to $10,000,  and jail term from 2 to 10 years.   An Ignition Interlock device will be ordered by the court.

Texas DUI Laws – Implied Consent Laws

Anyone driving a vehicle in Texas has given implied consent to submit to a BAC test.  Refusal results in a minimum 1 year license suspension.

 

Texas DUI Laws – “Per se” BAC Level

The per se BAC level in Texas is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

Texas DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in Texas is .o2%.  Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.

 

Texas DUI Laws – “Enhanced Penalty” BAC Level

There are enhanced penalties in Texas for a BAC greater than .16%,  and having a passenger under 15 in the car at time of offense.
