Washington DUI Laws – 1st Offense

First offense results in a driver’s license suspension of 90 days (1 year with BAC .15% or greater), fines from $865.50-$5000 (from $1,120.50 to $5,000 with with BAC .15% or greater), and a jail term from 24 hours to 1 year (2 days to 1 year with BAC.15% or greater), or Electronic Home Monitoring for 15 days (30 days with BAC .15% or greater.  An Ignition Interlock device will be ordered by the court (add 60 days if child under 16 was in the vehicle), as well as a possible alcohol/drug education program.

Washington DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension of 2 years (900  days with BAC .15% or greater), fines from $1,120.50-$5000 (from $1,545.50 to $5,000 with with BAC .15% or greater), and a jail term from 30 days to 1 year (45 days to 1 year with BAC.15% or greater), and Electronic Home Monitoring for 60 days (90 days with BAC .15% or greater.  An Ignition Interlock device will be ordered by the court (add 60 days if child under 16 was in the vehicle), as well as a possible alcohol/drug education program.

Washington DUI Laws – 3rd Offense

Third offense results in a driver’s license suspension of 3 years (4 years with BAC .15% or greater), fines from $1,970.50-$5000 (from $2,820.50 to $5,000 with with BAC .15% or greater), and a jail term from 90 days to 1 year (120 days to 1 year with BAC.15% or greater), and Electronic Home Monitoring for 120 days (150 days with BAC .15% or greater.  An Ignition Interlock device will be ordered by the court (add 60 days if child under 16 was in the vehicle), as well as a possible alcohol/drug education program.offense results in a driver’s license suspension from 180 days to 2 years, fines up to $10,000,  and jail term from 2 to 10 years.   An Ignition Interlock device will be ordered by the court.

Washington DUI Laws – Implied Consent Laws

Anyone driving a vehicle in Washington has given implied consent to submit to a BAC test.  First refusal results in a minimum 1 year license suspension.  Second refusal results in a 2 year minimum suspension.

The per se BAC level in Washington is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

The zero tolerance BAC level in Washington is .o2%.  Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.

There are enhanced penalties in Washington for a BAC greater than .15%,  and having a passenger under 16 in the car at time of offense.
